CLUB HAPPY DOG Standard Client Agreement
Club Happy Dog agrees to exercise due diligence in the care of my dog. My dog will be cared for by Club Happy Dog staff only, without liability on Club Happy Dog's part for loss or damage from disease, theft, fire, death, escape, injury or harm to persons, other dogs or property by my dog, or from other unavoidable causes, due diligence and care having been exercised by Club Happy Dog. I expressly agree that Club Happy Dog's liability shall in no event exceed the lesser of the current chattel value of a pet of the same species or the sum of $200.00 per dog. I further agree to be legally and financially responsible for any and all acts of behavior of my dog while in the care of Club Happy Dog.
Should my dog become ill or incur health states requiring professional attention, I authorize Club Happy Dog in its sole discretion to engage the services of a veterinarian or administer medicine or give other requisite attention to my dog. I authorize Club Happy Dog to charge my credit card on record for all associated costs and expenses.
My dog is/dogs are in good general health and will be current on all vaccines as required by Club Happy Dog each time he/she/they go for an excursion.
I agree that my dog(s) may be videotaped, photographed and/or recorded. Club Happy Dog shall be the exclusive owner of the results and all such tapings, photography and recordings will be used only by Club Happy Dog in its own promotion, advertising, sale or publicizing.
I acknowledge that Club Happy Dog reserves the right to refuse service to any dog.
I authorize Club Happy Dog to charge my account in accordance with your current Fees and Policies for my bookings. Excursion cancellations must be at least one business day in advance for credit. I recognize that Club Happy Dog's Pricing and Policies may change at any time without advance notice.
I represent myself as being the sole and/or primary owner of the dog(s) being enrolled. The dog is/dogs are free of any encumbrances and liens.
I agree that any controversy or claim arising out of or relating to this Agreement, or the breach thereof, or as the result of any claim or controversy involving the alleged negligence by any part to this Agreement, shall be settled by arbitration with the rules of the American Arbitration Association, and judgment up to the award rendered by an arbitrator may be entered in any Court having jurisdiction thereof. The arbitrator shall, as part of his award, determine an award to the prevailing party of the costs of such arbitration and reasonable attorney’s fees of the prevailing party.
